The Federal Ombudsperson for Protection Against Harassment (FOSPAH) has ruled that constant or excessive CCTV monitoring of employees constitutes workplace harassment.
The announcement follows multiple complaints from workers who reported feeling uncomfortable, intimidated, and under pressure due to continuous surveillance in their workplaces.
CCTV for Security vs. Harassment
According to FOSPAH, CCTV cameras can and should be used for legitimate safety and security purposes, but misuse of surveillance creates a toxic and distrustful work environment.
The watchdog explained that when employees feel like they are being monitored nonstop, it negatively impacts:
- Confidence
- Productivity
- Mental health
The ruling clarifies that while employers are allowed to install cameras in offices, factories, and other establishments, the primary purpose must remain security, not micro-managing staff or intimidating them.
Legal Implications for Employers
If CCTV footage is used to constantly monitor staff activity or exert unnecessary control, such practices will now be treated as harassment under the law.
FOSPAH stressed that employees are entitled to dignity and privacy, even within professional spaces. Employers, therefore, have a duty to foster trust and respect rather than resorting to excessive surveillance as a management tool.

The order also reminds workers that they can report cases of misuse of surveillance and seek legal protection if they feel their rights are being violated.
